1. Acceptance of Terms
By accessing and using Total 360 Security ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Total 360 Security provides AI-assisted security risk management assessments, policy templates, and consulting services to small and medium-sized businesses. The Service includes:
- Security assessment questionnaires based on industry frameworks
- AI-powered analysis and report generation
- Security policy templates and recommendations
- Progress tracking and metrics (for active subscribers)
- Expert consultation services (Premium tier only)
3. User Accounts
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Subscription and Payment
Total 360 Security offers two subscription tiers:
- Basic ($49.95/month): Unlimited security assessments, AI-powered document analysis, progress tracking & reporting, and policy library access
- Premium ($149.95/month): Everything in Basic plus dedicated security professional support and consultation
Subscriptions are billed monthly in advance. You may cancel your subscription at any time, but no refunds will be provided for partial months.
5. Use of AI and Automated Tools
The Service uses artificial intelligence to analyze security assessments and generate reports. You acknowledge that:
- AI-generated content is provided as guidance and recommendations only
- You are responsible for reviewing and validating all AI-generated recommendations
- The Service does not guarantee the accuracy or completeness of AI-generated content
- Final security decisions remain your responsibility
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Total 360 Security and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain all rights to data and information you submit to the Service. By submitting content, you grant us a license to use, store, and process your data solely for the purpose of providing the Service.
7. Prohibited Uses
You agree not to use the Service:
- For any unlawful purpose or to solicit others to perform unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Total 360 Security does not warrant that the Service will be uninterrupted, secure, or error-free.
The Service provides security guidance and recommendations but does not guarantee protection against security breaches or compliance with specific regulations.
9. Limitation of Liability
In no event shall Total 360 Security, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Indemnification
You agree to defend, indemnify, and hold harmless Total 360 Security and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Service.
11. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
